1. General Terms

By purchasing a puppy from Rose Country Labradoodles ("Seller"), the Buyer agrees to abide by all terms and conditions outlined herein and in the Pet Adoption Contract. These terms apply to all transactions involving the sale of Australian Labradoodle puppies by Rose Country Labradoodles, operated by Ashlea Cummerford, located in Red Deer, Alberta, Canada.

2. Deposits & Payments

  • A non-refundable deposit of $500 CAD is required to reserve a puppy.
  • Deposits are accepted via e-transfer (contact us for payment details).
  • The deposit may be transferred to a future litter if the Buyer is unable to take a puppy from their reserved litter, subject to Seller approval.
  • The remaining balance is due on the puppy pickup date.
  • All prices are in Canadian Dollars (CAD) and subject to applicable taxes (GST).

3. Puppy Selection & Pickup

  • Rose Country Labradoodles reserves the right to match puppies to families based on temperament, lifestyle, and suitability.
  • Puppy selection is not guaranteed solely on deposit order; the best match for both the puppy and the family is prioritized.
  • Puppies are available for pickup at approximately 8 weeks of age, or as determined by the Seller.
  • If the Buyer fails to pick up the puppy within 7 days of the agreed pickup date without prior arrangement, additional boarding fees may apply.

4. Health Guarantee Limitations

  • The 2-year health guarantee covers debilitating congenital defects only, up to the purchase price of the puppy.
  • The guarantee does not cover: viral illnesses, bacterial infections, parasitic conditions (worms, giardia, coccidiosis), improper bites, umbilical hernias, hypoglycemia, allergies, or conditions resulting from injury, neglect, or environmental factors.
  • The guarantee is void if the Buyer fails to spay/neuter the puppy by 6 months of age, or fails to maintain proper veterinary care.
  • No guarantee claim will be honored without a written veterinary diagnosis from a licensed veterinarian.

5. Spay/Neuter Agreement

All puppies sold by Rose Country Labradoodles are sold on a non-breeding agreement. The Buyer agrees to:

  • Have the puppy spayed or neutered by 6 months of age at the Buyer's expense.
  • Provide written proof of the procedure from a licensed veterinary clinic, including pet description, breed, and microchip number.
  • Failure to comply may result in the Seller reclaiming the dog and/or the imposition of a breeding penalty fee.

6. Limitation of Liability

  • Rose Country Labradoodles' liability is limited to the purchase price of the puppy.
  • The Seller is not responsible for any veterinary expenses, consequential damages, emotional distress, or other costs incurred by the Buyer after the sale.
  • The Buyer assumes full responsibility for the health, safety, and well-being of the puppy upon taking possession.

7. Return & Rehoming Policy

  • If the Buyer can no longer care for the dog at any point in its life, the Buyer must contact Rose Country Labradoodles first. We will assist with rehoming or accept the dog back.
  • Under no circumstances should the dog be surrendered to a shelter or rescue without first contacting the Seller.
  • No refunds will be issued for returned dogs except as outlined in the Health Guarantee.

8. Privacy Policy

Personal information collected during the adoption process (name, address, email, phone) will be used solely for the purposes of the puppy adoption, ALAA registration, and ongoing communication regarding your puppy. We will never sell or share your personal information with third parties.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising from this agreement shall be resolved in the courts of Alberta.
